1. Services

Mario Cotera Images (“MCI”) provides professional real estate media services, including but not limited to:

Interior and exterior photography
Aerial (drone) photography and videography
Property Video
Social media vertical content
Twilight editing (virtual or natural)
Floor plans
3D Virtual Tours
Image retouching and editing services

All services are subject to availability and confirmation.

2. Booking & Payment Terms

2.1 Booking

Appointments must be scheduled in advance through the MCI’s client portal, email, or text.

2.2 Payment

Payment is due at the time of booking or prior to media delivery.
MCI reserves the right to withhold final media delivery until payment is received in full.
Late payments may incur additional fees.

2.3 Pricing

Prices are subject to change without notice. Confirmed bookings will honor the agreed price at the time of booking.

3. Cancellation & Rescheduling Policy

3.1 Cancellations

Cancellations made less than 24 hours before the scheduled appointment may be subject to a cancellation fee.
Same-day cancellations may be charged up to 100% of the service fee.

3.2 Weather & Unforeseen Circumstances

For drone services or outdoor photography:

Weather conditions may require rescheduling for safety and quality reasons.
MCI reserves the right to reschedule due to unsafe conditions.

4. Property Readiness

The client is responsible for ensuring the property is fully prepared prior to the scheduled shoot.

Mario Cotera Images is not responsible for:

Cleaning
Staging
Removing clutter
Landscaping adjustments
Turning on utilities

If the property is not ready, MCI may:

Proceed as-is, or
Charge an additional fee if the shoot goes beyond the allotted time due to cleaning and staging the property while the photographer waits.
Reschedule and charge a reshoot fee.

5. Copyright & Licensing

5.1 Ownership

All photographs, videos, and media created by Mario Cotera Images remain the intellectual property of the Company.

5.2 License to Client

Upon full payment, the client is granted a non-transferable, limited license to use the media for:

Marketing the specific property
MLS listings
Social media promotion
Personal branding related to that listing

5.3 Restrictions

Media may NOT be:

Sold or transferred to another agent without written permission
Used by builders, stagers, or third parties without licensing approval
Edited or altered beyond basic cropping or resizing without consent

6. Drone & Aerial Services

Drone services are provided in compliance with FAA regulations.

Drone flights are subject to:

Airspace restrictions
Weather conditions
Property accessibility
Local regulations

If flight is restricted, MCI may:

Provide alternate coverage, or
Adjust pricing accordingly

7. Delivery & Turnaround

Standard turnaround times:

Photography: 24 hours
Video: 48-72 hours
Twilight edits: 24 hours
3D Virtual Tours: 24 hours
Floor Plans: 24 hours

Delivery is made via digital download link.

MCI is not responsible for:

Client email filtering issues
Download delays caused by third-party platforms

8. Limitation of Liability

Mario Cotera Images shall not be liable for:

Indirect or consequential damages
Loss of listing opportunity
MLS errors
Marketing performance results

Total liability shall not exceed the total amount paid for the specific service.

9. Indemnification

Client agrees to indemnify and hold harmless Mario Cotera Images from any claims arising from:

Unauthorized use of media
Property access issues
Misrepresentation of property features

10. Force Majeure

MCI shall not be held liable for delays or inability to perform services due to:

Weather
Natural disasters
Government restrictions
Equipment failure beyond reasonable control
Acts of God

11. Model Release

By allowing photography or video at the property, the client confirms:

They have permission to grant access
Any individuals appearing in media have consented
MCI may use media for portfolio and marketing purposes unless otherwise requested in writing
